General Terms and Conditions

Article 1 – Definitions

In these general terms and conditions, the following definitions apply:

  1. Hanna Valiullina: the hair salon/colorist located at [Address], registered with the Chamber of Commerce (Kamer van Koophandel) under number 93708440, trading under the name Touch of Beauty by Hanna.
  2. Client: any natural or legal person who uses the services of Hanna Valiullina and/or makes an appointment, whether online or offline.
  3. Agreement: every appointment/booking between Hanna Valiullina and the client for the provision of hairdressing and/or colorist services.
  4. Services: all treatments offered by Hanna Valiullina, such as cutting, coloring, blow-drying, styling, care, and related activities.
  5. Website / Online Booking System: the website of Hanna Valiullina (hannavaliullina.nl) and the linked online reservation system allowing clients to book appointments.

Article 2 – Applicability

  1. These general terms and conditions apply to all quotations, offers, appointments, treatments, and other legal relationships between Hanna Valiullina and the client.
  2. By making an appointment (by telephone, in the salon, via social media, or via the online booking system), the client agrees to these general terms and conditions.
  3. Deviations from these general terms and conditions are only valid if they have been expressly confirmed in writing by Hanna Valiullina.

Article 3 – Appointments and Online Booking

  1. Appointments can be made:
    • by telephone;
    • in the salon;
    • via the online booking system on the website;
    • via other channels offered by Hanna Valiullina.
  2. The client is responsible for correctly entering data during online bookings (name, email address, phone number, and desired treatment(s)).
  3. An online booked appointment is only final after receipt of a confirmation via email or SMS from the system.
  4. Hanna Valiullina reserves the right to refuse or reschedule appointments, for example in case of unforeseen circumstances, double bookings, or non-compliance with these conditions.

Article 4 – Cancellation, Changes, and No-Show

  1. Canceling or changing an appointment is free of charge up to 24 hours before the scheduled appointment. This can be done by telephone, email, or via the online system.
  2. In case of cancellation within 24 hours before the appointment, Hanna Valiullina is entitled to charge a percentage of the reserved treatment amount. For example:
    • Cancellation between 24–48 hours: 50% of the treatment amount;
    • Cancellation within 24 hours or no-show: 100% of the treatment amount.
  3. In the event of a no-show (the client does not show up without cancellation), Hanna Valiullina may charge the full cost of the booked treatment.
  4. In case of illness, force majeure, or other serious circumstances, Hanna Valiullina is entitled to reschedule or cancel the appointment free of charge. If possible, a new appointment will be proposed.

Article 5 – Prices and Payments

  1. All prices for treatments and products are listed in the salon and/or on the website.
  2. Hanna Valiullina reserves the right to change prices. Changed prices do not affect already definitively booked appointments, unless a clear error was made in the price indication.
  3. Payment must be made immediately after the treatment, unless agreed otherwise.
  4. Payment can be made via the payment methods available in the salon (e.g., cash, debit card, credit card, or other options), and if applicable, via online payment methods when booking.
  5. Discount promotions, gift cards, and vouchers are only valid under the conditions specifically stated for that promotion or voucher and are not exchangeable for cash.

Article 6 – Gift Cards and Vouchers

  1. Gift cards from Hanna Valiullina are personal or transferable, depending on what is stated on them, and are valid for 1 year after the issue date, unless indicated otherwise.
  2. Gift cards can only be used for services and/or products as indicated by Hanna Valiullina.
  3. In case of loss, theft, or damage to a gift card, Hanna Valiullina is not obliged to provide a replacement.

Article 7 – Client Responsibilities

  1. The client is obliged to inform Hanna Valiullina before the treatment regarding:
    • allergies;
    • a sensitive or damaged scalp;
    • recent medical treatments or medication use that may affect the treatment;
    • previous allergic reactions to hair products or colorants (such as PPD).
  2. For color treatments, Hanna Valiullina may advise performing an allergy test (patch test) beforehand. If the client refuses this or does not schedule a timely test moment, this is at their own risk.
  3. The client must arrive on time for the appointment. In case of late arrival, Hanna Valiullina may decide to shorten the treatment or not perform it (fully), in which case the rate may be charged (partially).

Article 8 – Minors

  1. Treatments for minors are only allowed with the consent of a parent or legal guardian.
  2. For color treatments on minors, Hanna Valiullina reserves the right to refuse these or set additional conditions.

Article 9 – Result and Warranty

  1. Hanna Valiullina will perform the treatment to the best of her knowledge and ability, using professional products and techniques. However, this concerns a best efforts obligation, not an obligation of result.
  2. Hair color, structure, and condition vary per person. Therefore, Hanna Valiullina cannot give an absolute guarantee on the final result, especially with color corrections and hair that has previously been chemically treated.
  3. If the client is not satisfied with the treatment, he/she must make this known to Hanna Valiullina within 5 working days after the treatment. In consultation, a suitable solution will be sought (e.g., touch-up or adjustment).
  4. Costs for additional treatments will only be reimbursed or performed free of charge if Hanna Valiullina deems the request reasonable and if the complaint was reported immediately after discovery.

Article 10 – Liability

  1. Hanna Valiullina is not liable for damage caused because the client provided incorrect or incomplete information about relevant physical or medical circumstances, allergies, or previous hair treatments.
  2. Hanna Valiullina is not liable for indirect damage, consequential damage, or lost income resulting from a treatment.
  3. Insofar as Hanna Valiullina would be liable, the liability is limited to a maximum of the amount of the treatment in question.
  4. Use of products purchased by the client after advice in the salon or via the website is at the client's own risk. Always read the instructions and warnings on the packaging.

Article 11 – Damage, Theft, and Loss

  1. The client is liable for damage to Hanna Valiullina's property caused by their actions.
  2. Hanna Valiullina is not liable for loss, theft, or damage to personal property of the client in or around the salon.

Article 12 – Hygiene, Safety, and House Rules

  1. Hanna Valiullina works according to applicable hygiene and safety standards.
  2. The client is expected to follow the house rules of the salon.
  3. Hanna Valiullina has the right to refuse a client access to the salon or terminate the treatment in case of unacceptable behavior (e.g., aggression, discrimination, intimidation, or repeated no-shows).

Article 13 – Online Booking System and Technical Faults

  1. Hanna Valiullina strives for a properly functioning online booking system but cannot guarantee that it will always function without errors.
  2. In case of technical faults, errors in the booking confirmation, or obvious mistakes (e.g., unrealistic prices), Hanna Valiullina reserves the right to correct or cancel the appointment.
  3. In such cases, Hanna Valiullina will contact the client as soon as possible to offer a new appointment or solution.

Article 14 – Photos, Social Media, and Intellectual Property

  1. Hanna Valiullina may, with the client's consent, take photos of the hair before and/or after the treatment for use on social media, the website, or other promotional materials.
  2. The client may always withdraw this consent for future use. Already published photos will be removed where possible in consultation with the client.
  3. All photos, texts, and other (digital) content created by Hanna Valiullina are protected by copyright and may not be used, copied, or distributed without written permission.

Article 15 – Personal Data and Privacy

  1. Hanna Valiullina processes personal data of clients in accordance with the General Data Protection Regulation (GDPR).
  2. Personal data is used for:
    • making and managing appointments;
    • sending (confirmation) messages about appointments;
    • keeping treatment history if relevant for future treatments;
    • possibly sending newsletters/offers (only with the client's consent).
  3. The client has the right to access, rectify, or have their data deleted, insofar as the law allows.

Article 16 – Complaints Procedure

  1. If the client has a complaint about a treatment or the service of Hanna Valiullina, this must be made known as soon as possible – no later than within [e.g., 5 or 14 days] – after the cause of the complaint arises, preferably in writing (by email or via the contact form).
  2. Hanna Valiullina will handle the complaint as soon as possible, no later than within 14 working days, and will seek a suitable solution in consultation with the client.
  3. If parties cannot reach an agreement together, the client may turn to any affiliated disputes committee or the competent court.

Article 17 – Force Majeure

  1. Hanna Valiullina is not obliged to fulfill any obligation if she is prevented from doing so due to a circumstance that is not due to her fault and which is not for her account under the law, a legal act, or generally accepted views (force majeure).
  2. Force majeure includes, among other things: illness of the stylist/colorist, power or internet failures, fire, water damage, pandemics, government measures, malfunctions in the online booking system, or other events beyond the control of Hanna Valiullina.

Article 18 – Applicable Law and Competent Court

  1. Dutch law applies exclusively to all legal relationships between Hanna Valiullina and the client.
  2. Disputes arising from or related to the services of Hanna Valiullina will be submitted exclusively to the competent court in the district where Hanna Valiullina is established, unless mandatory law prescribes otherwise.
